PREFACE
This publication, consisting of Volumes I and II, and a separately bound volume of zoning ordinances, is a republication of the Charter of the City of Phoenix and the Code of the City of Phoenix, 1969. Except as otherwise noted, the original arrangement and the original numbering system have been retained. State law references have been verified and updated. A uniform style of punctuation and capitalization has been employed. Obvious typographical errors and misspellings have been corrected without notation. Figures have been deleted where they are merely a repetition of written words. Words or phrases added to the text by the editor for clarity are enclosed in brackets. None of the revisions are intended to effect a substantive change in the existing law or to alter the sense, meaning or effect of any ordinance.
Source materials for the republication were the City's 1969 Code as updated through Ordinance No. G-4269, adopted May 17, 2000, and subsequent amendments through Ordinance No. G-4328, adopted February 7, 2001. This publication omits all special ordinances, all titles to ordinances, all enacting and repealing clauses, all declarations of emergency, and all purpose, validity and construction clauses unless, from their nature, it may be necessary to retain them to preserve the full meaning and intent of the ordinance. The original true and correct text of the Charter and all general ordinances, and all subsequent amendments, is on file and a matter of record in the office of the City Clerk.
Page Numbering System
The page numbering system used in this Code is a prefix system. The letters to the left of the colon are an abbreviation which represents a certain portion of the volume. The number to the right of the colon represents the number of the page in that portion. In the case of a chapter of the Code, the number to the left of the colon indicates the number of the chapter. The following are typical parts of codes of ordinances, which may or may not appear in this Code at this time, and their corresponding prefixes:

As part of the republication project, new comprehensive indexes were prepared. Each subject has been placed under several headings, some couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the indexes themselves which stand as guideposts to direct the user to the particular item in which the user is interested.
Looseleaf Supplements
A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendments will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.
Keeping this publication up-to-date at all times will depend largely upon the holder of the publication. As revised pages are received, it will then become the responsibility of the holder to have the amendments inserted according to the attached instructions. The Charter of the City of Phoenix, the City Code, the Zoning Ordinance and the Index constitute what is ordinarily referred to as the Phoenix City Code. The ordinances are classified according to subject matter with each chapter preceded by a table of contents. The index relates to the entire subject matter.
The Charter is changed only when amended, added to or repealed by a majority vote of the voters of the City of Phoenix. The general ordinances and the zoning ordinances are amended, added to or repealed by enactment of the Phoenix City Council. Subscribers to the Phoenix City Code receive a monthly supplement which makes the authorized changes.
The City Clerk's office is the depository for all ordinances enacted by the Phoenix City Council. Inquiries relating to the history or previous enactment of ordinances may be directed to the staff of the City Clerk's office.
The Law Department under the direction of Andy Baumert, City Attorney, has undertaken the task of editing, updating, printing and maintenance of the City Charter and Code beginning in 1977 and has brought about the present service level to its subscribers.
ADOPTION OF CODE

AN ORDINANCE ADOPTING A REVISION AND CODIFICATION OF THE GENERAL ORDINANCES OF THE CITY OF PHOENIX, ENTITLED "THE CODE OF THE CITY OF PHOENIX, 1969"; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, WITH CERTAIN EXCEPTIONS RELATING TO MATTERS SAVED FROM REPEAL; PROVIDING PENALTIES; AND FOR OTHER PURPOSES HEREINAFTER SET OUT; AND ESTABLISHING AN EFFECTIVE DATE OF JANUARY 14, 1969.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX as follows:
Sec. 1. Adoption.
There is hereby adopted that certain Code entitled "The Code of the City of Phoenix, 1969," containing certain ordinances of a general and permanent nature as compiled, consolidated, codified and indexed in Chapters 1 to 39, both inclusive, of which Code not less than three copies have been and are now filed in the office of the City Clerk and which is hereby referred to and adopted by reference as if incorporated and set out at length in this ordinance. The City Clerk is also instructed to post all other copies as provided by law.
Sec. 2. Repeal of prior ordinances.
The provisions of such Code shall be in force and effect on and after January 14, 1969, and all ordinances of a general and permanent nature in force on January 1, 1968, and not contained in such Code are hereby repealed from and after January 14, 1969, except as hereinafter provided.
Sec. 3. Exceptions to repeal of prior ordinances.
The repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before January 14, 1969; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the City or authorizing the issue of any bonds of the City or any evidence of the City's indebtedness or any contract or obligation assumed by the City; nor shall such repeal affect the administrative ordinances or resolutions of the Council not in conflict or inconsistent with the provisions of such Code; nor shall it affect the annual tax levy, nor shall it affect any right or franchise conferred by ordinance or resolution of the City on any person or corporation; nor shall it affect any ordinance relating to the salaries of the City officers or employees; nor shall it affect any ordinance annexing territory to the City; nor shall it affect any ordinance naming, opening, accepting or vacating streets or alleys in the City, nor shall it affect any ordinance relating to zoning; nor shall it affect any ordinance adopted on final reading and passage after January 1, 1968.
Sec. 4. Technical codes saved from repeal.
The repeal provided for in Section 2 of this ordinance shall not affect the Building Code of the City of Phoenix (Ord. No. G-573) or any amendment thereto; nor shall such repeal affect the Electrical Code of the City of Phoenix (Ord. No. G-734) or any amendment thereto; nor shall such repeal affect the Fire Prevention Code recommended by the National Board of Fire Underwriters (1953 Edition) (adopted by Ord. No. G-144) or any amendment thereto; nor shall such repeal affect the Gas Code of the City of Phoenix (Ord. No. G-364) or any amendment thereto; nor shall such repeal affect the Mechanical Code of the City of Phoenix (Ord. No. G-137) or any amendment thereto; nor shall such repeal affect the Plumbing Code of the City of Phoenix (Ord. No. G-71) or any amendment thereto.
Sec. 5. Penalty.
Whenever in the Code adopted by this ordinance or in any other ordinance of the City any act is prohibited or is made or declared to be unlawful or an offense, or the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of such Code or any other ordinance of the City shall be punished by a fine not exceeding three hundred dollars or imprisonment for a term not exceeding six months, or by both such fine and imprisonment.
Every day any violation of such Code or any other ordinance of the City shall continue shall constitute a separate offense.
Sec. 6. Severability.
It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance and the Code hereby adopted are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance and the Code hereby adopted shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance or the Code hereby adopted.
Sec. 7. Effective date.
This ordinance shall be effective on and after January 14, 1969.
