Sec. 26-1. Library Advisory Board– Creation; composition.

There is hereby created a Library Advisory Board to consist of seven members to be appointed by the City Council.

Sec. 26-2. Library Advisory Board– Term of members; vacancies.

The term of office of the members of the Library Advisory Board shall be for three years. The terms of members sitting on the Board on the effective date of this ordinance shall be as specified in Ordinance No. S-17643. Any vacancy occurring shall be filled by appointment by the Mayor, subject to the approval of the City Council, such appointment to be for the balance of the unexpired term.

Sec. 26-3. Library Advisory Board– Compensation of members.

The office of members of the Library Advisory Board shall be honorary and without salary or compensation.

Sec. 26-4. Library Advisory Board– Duties and responsibilities.

(a) The Library Advisory Board shall be, and is hereby vested with advisory authority only in all matters relating to the Phoenix library system, i.e., the Phoenix Public Library and any and all branches thereof.

(b) The Board shall inform and advise the City Council on matters of public interest and need in relation to the resources and services of the library system.

(c) The Board shall meet regularly with the Library Director to receive administrative reports on the operation and public use of the library system, as well as administrative reports on studies and appraisals relating to future change and development of the library system, and shall advise the Library Director on the public's needs and interests in relation to these matters.

(d) The members of the Board shall annually elect a chairman and vice-chairman from their membership, and may adopt such rules for the proper operation of said Board as they deem expedient which shall be consistent with the Arizona State Constitution, with Arizona statutes, and with the Charter and ordinances of the City of Phoenix.

Sec. 26-5. Library Department– Duties of Director.

There shall be a Library Department administered by a Library Director who shall be accountable to the City Manager. Said Director shall administer the operation and service functions of the library system and shall plan and recommend to the Library Advisory Board and to the City Manager such changes in the composition and operation of the library system as he deems proper for the protection and maintenance and further development of the library system.

Sec. 26-6. Library Department– Divisions.

The Library Department shall be organized into the following divisions, the heads of each of which shall be responsible to the Library Director:

(a) Technical Services Division;

(b) Central Library Division; and

(c) Extension Services Division.

Sec. 26-7. Mutilation of books and library property.

It shall be unlawful for any person to mar, deface, mutilate or in any way injure any book, paper, periodical, or newspaper, the property of or contained in any public library, or to mar, deface, mutilate or in any way injure any property, real or personal, or any furniture or fixtures contained in any public library of the City.

Sec. 26-8. Retention of library books or other library property after notice to return unlawful.

It shall be unlawful to retain any book, newspaper, magazine, pamphlet, manuscript or other property belonging in or to, or on deposit with, the Phoenix public library, or any branch or bookmobile operated in connection therewith, for a period exceeding twenty-one days after notification by first class mail to the borrower's address on file with such library, given after the expiration of the time during which by the rules of the library such article or other property may be kept; such notice shall bear on its face a copy of this section.

Sec. 26-9. Use of library by County residents living outside City.

Authority is hereby granted to residents of Maricopa County living beyond the corporate limits of the City to obtain books from the City library upon the fees and conditions prescribed by the City Manager.
