ASSISTANT CITY ATTORNEY IV
ASSIGN: PROSECUTOR(Non-classified)

DISTINGUISHING FEATURES OF THE CLASS:

The fundamental reason this classification exists is to perform complex legal, professional, and administrative work, including the supervision of the Legal Section of the City Prosecutor's Office, Assistant City Attorneys III, Assigned: Prosecutor, and support staff. A supervising Prosecutor consults with representatives of other City departments on criminal matters affecting the City Prosecutor's Office, serves as a member of the City Prosecutor's management team, participates in specialized legal and administrative assignments, performs legal research, drafts legal memoranda, and handles appellate oral arguments in the highest courts in the state and federal systems. Work is performed in accordance with established standards and practices of the legal profession and City and departmental policy. Performance is evaluated by the City Prosecutor and Deputy City Prosecutor through review of results achieved. The scale of work and supervisory training responsibilities distinguish this classification from the Assistant City Attorney III, Assigned: Prosecutor.
ESSENTIAL FUNCTIONS:
- Supervises and monitors Assistant City Attorneys II and III, assigned as Prosecutors;
- Supervises, monitors, and evaluates Legal Clerks III;
- Answers legal, tactical, administrative, and policy questions from Assistant City Prosecutors II, Team Captain Attorneys III, and support staff;
- Assists in the formulation of policy and work responsibilities for Assistant City Prosecutors II, Team Captain Attorneys III, and Legal Clerks III;
- Assists in managing day-to-day operations;
- Represents the City in various courts;
- Prepares and coordinates the master daily schedule for attorneys;
- Schedules continuing legal education for attorneys, including attendance at seminars and in-house presentations;
- Coordinates leave management of Assistant City Prosecutors II, Team Captain Attorneys III, and Legal Clerks III;
- Assumes managerial responsibility for the bureau in the absence of the Deputy City Prosecutor;
- Handles special assignments from the City Prosecutor or Deputy City Prosecutor;
- Trains and serves as a resource for new attorneys;
- Formulates office policy and procedures;
- Represents the City Prosecutor's Office on committees and at meetings with other City departments and outside agencies;
- Participates in and provides leadership to Law Department standing committees;
- Creates and maintains bureau training outlines, business systems, and manuals;
- Responds to outside inquiries and requests on legal issues;
- Presents legal and managerial reports orally and in writing;
- Renders oral and written opinions on legal questions and issues impacting the Office;
- Drafts ordinances and legislation as assigned by the City Prosecutor;
- Reviews proposed State and City legislation that may impact the City;
- Represents the City Prosecutor at public speaking engagements and presentations to government and community agencies;
- Participates in budgetary planning and decision making;
- Reviews attorney job applications, participates in interviews, and communicates hiring decisions to applicants;
- Demonstrates continuous effort to improve operations, decrease turnaround times, streamline work processes, and work cooperatively and jointly to provide quality seamless customer service.
Required Knowledge, Skills and Abilities:

- Civil and criminal law, procedure, and appellate process.
- Principles of trial advocacy and applicable law.
- Federal and state constitutional and statutory provisions relating to municipalities and the rights of citizens in criminal, traffic, and forfeiture cases.
- Court procedures and applicable rules.
- Departmental and office policies and procedures.
- City, departmental, and office rules and regulations.
- Principles and practices of personnel management and supervision.
- Utilize City codes, charter, and ordinances, especially those authorizing criminal penalties.
- Comprehend and make inferences from written material.
- Produce documents written in the English language using proper sentence structure, punctuation, grammar, and spelling.
- Work cooperatively with other employees, customers, clients, and the public.
- Review the work products of others to ensure accuracy.
- Analyze alternative approaches to legal and managerial issues.
- Perform a broad range of supervisory responsibilities over others.
- Communicate orally in the English language with customers, clients, and the public using a telephone and in group and face-to-face, one-to-one settings.
- Enter and retrieve data or information from a terminal, PC, or other keyboard device.
- Remain in a sitting position for extended periods of time.
Additional Requirements:
- Some positions will require the performance of other essential and marginal functions depending upon work location, assignment, or shift.
- Continued admission to the State Bar of Arizona.
ACCEPTABLE EXPERIENCE AND TRAINING:
Four years of experience as a practicing criminal attorney, including substantial involvement in the management process and policy making function of a law office, graduation from an accredited school of law, and admission to the State Bar of Arizona. Other combinations of experience and education that meet the minimum requirements may be substituted.
