Procurement/City Clerk Section
The Procurement/City Clerk Section represents a broad spectrum of City departments and functions including, but not limited to: City Clerk, Engineering and Architectural Services, Finance, Fire, Housing, Library and Street Transportation. The six lawyers assigned to this section act as in-house counsel to these departments and represent them in litigation in all courts in Arizona and in various administrative proceedings. The section also assists in drafting and reviewing City agreements of all kind, ordinances and state legislation.
As a result of representing these City departments and functions, the section provides legal advice related to numerous matters:
- Licensing application and enforcement of various licensing ordinances for second-hand dealers, auctioneers, scrap metal dealers, escort bureaus, massage establishments, sexually-oriented businesses, street, sidewalk and mobile vendors, among others;
- Annexation, elections, public records, open meeting law and conflicts of interest;
- Oversight of construction transactions and litigation, and the procurement of design and construction services for the City;
- Administration of the City's privilege license and use tax;
- Collection of the City's outstanding debts for unpaid taxes, damages to City property, and other moneys owed the City;
- Representation of the Purchasing Division and serving as a resource for the procurement of goods and services for the City and on bankruptcy issues;
- Forcible detainer actions involving public housing tenants; and
- Drafting of intergovernmental agreements and legal advice related to traffic operations, traffic mitigation and improvement districts.
