REGULATORY UPDATE


Enforcement Response Plan

To achieve the greatest degree of compliance by industrial users, the city of Phoenix uses a variety of enforcement actions. Enforcement actions available might range from a simple reminder telephone call, to termination of services and assessment of penalties. Certain intentional violations may constitute criminal violations of Federal, State, and City Law. The City has developed a Civil Penalty Policy containing detailed procedures as to how the Pollution Control Division will calculate civil penalties for instances of industrial user noncompliance.

While enforcement of laws and securing penalties for violations is a part of the city's responsibilities we work closely with our regulated industries to prevent problems from happening. To achieve the goal of prevention rather than punishment, education programs such as the Pretreatment Compliance Academy and rewards for successful compliance are key parts of the Phoenix approach.

The City has developed an Enforcement Response Plan or ERP. The purpose of our ERP is to describe the range of available enforcement actions. The plan identifies how the city of Phoenix Pollution Control Division will investigate and respond to instances of industrial user noncompliance.

Our Enforcement Response Guide is intended as a quick, ready reference tool to address violations. It should be used together with the more explanatory ERP.

Significant Noncompliance (SNC)

An industrial user is in a state of Significant Noncompliance (SNC) when violations meet one or more special criteria.
