Dog Bite Cases
The Phoenix City Code § 8-14 makes it unlawful for a dog to be "at large" meaning that it is not confined on a property or on a 6 foot leash. The City Code also requires dogs older than three months to wear a collar or harness with a valid license attached. If an individual or another animal is bitten by a dog that is "At Large", Maricopa County Animal Care and Control will issue a Dog at Large citation.
What is the difference between a Civil and Criminal "Dog at Large" charge?
A civil Dog at Large charge is issued if the dog is wearing a collar or harness with a valid license and is unconfined. The defendant may receive a fine ranging from $0 to $250.
A criminal Dog at Large charge is issued if the dog is not wearing a collar or harness with a valid license and is unconfined. The defendant may receive a fine ranging from $0 to $2,500, probation from 0 to 3 years, and jail from 0 to 180 days.
May I request Restitution?
If the defendant is charged with a Dog at Large violation and you, your child, or your pet were injured, you may request restitution through the court for any out of pocket expenses as a direct result of the bite incident. This may include medical bills, vet bills, lost wages, co-pays, etc. However, it is always up to the judge as to whether you are awarded any restitution upon a conviction. You may Request Restitution Here.
