Protection Orders
Protection orders are civil court orders prohibiting a specific person from coming near your home, work site, school, or other locations as listed on the order. You must appear in person at the Phoenix Municipal Court or at other court locations as listed below. Once you complete the paperwork, you will meet with a judge to discuss your request. If granted by the judge, the Protection Order is issued and must then be served by a police officer, deputy sheriff or process server. Protection orders are effective for 12 months from service date. Please be aware that not all requests are granted and the person against whom the protection order is issued may request a hearing after it is served.
There are three types of protection orders: (1) Order of Protection, (2) Injunction Against Harassment, and (3) Injunction Against Workplace Harassment.
Order of Protection
To be eligible for an Order of Protection, you must have one of the following relationships with the person against whom you are seeking the Order of Protection pursuant to A.R.S. § 13-3602:
- The parties are married, separated or divorced.
- The parties live together, or lived together in the past.
- The parties are the parents of a child in common.
- One of the parties is pregnant by the other.
- One of the parties is a parent, grandparent, in-law or sibling.
Injunction Against Harassment
An Injunction Against Harassment is used for harassment by a person that does not fall in one of the above Order of Protection relationship categories pursuant to A.R.S. § 12-1809.
Injunction Against Workplace Harassment
An employer, or an authorized agent of an employer, may request an Injunction Against Workplace Harassment against a defendant if there is reasonable evidence of workplace harassment by the defendant or that good cause exists to believe that great or irreparable harm would result to the employer or other person who enters the employer's property or who is performing official work duties pursuant to A.R.S. § 12-1810.
