Water Resources Acquisition Fee Update The city of Phoenix is currently going through the process of amending the Water Resources Acquisition Ordinance (Chapter 30 of the City Code) As part of this process, the city is notifying residents, property holders, and other parties with development interests of this intention.
Associated with the revised ordinance are increases in the water resource fees charged to new development(s). Water resource fees are paid at the time the city of Phoenix building permits are obtained or water connections to the city of Phoenix systems take place. These changes would result in additional water resource fees being charged when building permits or water connections result in additional water services. Except in situations where connections to city of Phoenix water services are involved, these proposed changes will not affect properties currently in county islands.

Written comments on the proposed changes may be sent by mail to the Water Services Department, 200 West Washington Street, 9th Floor, Phoenix, AZ 85003, or by email to douglas.frost@phoenix.gov. . A public hearing will be held by the City Council to consider this matter no earlier than 60 days from March 21, 2008. At the hearing, citizens will have an opportunity to express their views concerning the proposed amendments.
NOTICE ABOUT PUBLIC HEARING
The Phoenix City Council will hold a public hearing as part of the Formal Council Meeting on May 28, 2008, to receive comments about the City Council’s intention to amend Chapter 30 of the Phoenix City Code entitled “WATER RESOURCES ACQUISITION FEE ORDINANCE OF THE CITY OF PHOENIX” pertaining to proposed increases in the Water Resources Acquisition Fee (WRAF), which is charged to new development based on meter size (commercial) or number of new units (residential), and the geographic location of the proposed development. More specifically, this hearing will allow members of the public to comment on the three documents used to justify the proposed WRAF increases, as well as on proposed changes to Chapter 30 of the Phoenix City Code, which will implement those changes. This hearing would be held in accordance with Arizona Revised Statute 9-463.05.
The three documents that form the basis of the WRAF increases are: Water Resources Acquisition Fee Update – Phase 1 Technical and Cost Data; Water Resources Acquisition Fee Update - Phase 2 Fee Determination and Assessment; and Water Resources Acquisition Fee Update - Infrastructure Improvements Plan.
Proposed changes to Chapter 30 of the Phoenix City Code include revisions to Section 30-3 (Definitions.), Section 30-4 (Calculation of the water resources acquisition fee.), Section 30-5 (Calculation of offsets.), Section 30-6 (new - Automatic Adjustments.), and Section 30-11 (Appeals.).
