Stipulations
Site Plan and Elevations
1.
That the development shall be in general conformance with the site plan date stamped October 2, 2008, as modified by the following stipulations and approved by the Development Services Department.
2.
That the development shall be in general conformance to the elevations date stamped October 2, 2008, except that the south and east elevations shall utilize additional architectural embellishments such as banding, offsets, pop-outs, accent materials, and detailing to break up building mass on the top portion of the building above the overhead doors, as modified and approved by the Development Services Department.
Landscaping and Walls

That the development shall be in general conformance with the landscape plan date stamped October 2, 2008, with specific regard to the minimum 20-foot landscaped setback depicted on the site plan date stamped October 2, 2008, except that there shall be a mix of two-inch and three-inch caliper trees provided, as approved by the Development Services Department.

That an average 25-foot landscape setback shall be provided along the Rio Salado, to include the trail, as approved by the Development Services Department.
5.
That the developer shall dedicate a 20-foot public multi-use trail easement and construction of a fully accessible 12-foot asphaltic concrete shared-use path along the north property line (adjacent to Rio Salado), as approved or modified by the Development Services Department.
6.
That the development shall utilize the Rio Salado Habitat Restoration Area landscape palette, as approved by the Development Services Department.
7.
That all perimeter and screen walls adjacent to a street shall be a minimum of eight feet in height and include material and textural differences, such as stucco and/or split face block with a decorative element, such as tile, glass insets, or stamped designs on the exterior, as approved by the Development Services Department.
8.
That the entrance gates shall be made of a decorative metal that completely screens the outdoor storage area of the site, as illustrated in Detail C on the detail plan date stamped October 2, 2008, as approved by the Development Services Department.
9.
That the development shall provide a five-foot-wide detached sidewalk to be consistent with the Rio Salado Scenic Drive along the south property line, as approved by the Development Services Department.
Aviation
10.
That the property owner shall record documents that disclose the existence and operational characteristics of Phoenix Sky Harbor International Airport to future owners or tenants of the property. The form and content of such documents shall be according to the templates and instructions provided which have been reviewed and approved by the City Attorney.
Street Transportation
11.
That right-of-way totaling 33 feet shall be dedicated for the west half of 28th Street, as approved by the Development Services Department.
12.
That an 18-foot right-of-way radius shall be dedicated at the northwest corner of 28th Street and Elwood Street, as approved by the Development Services Department.
13.
That the developer shall construct all streets adjacent to the development with paving, curb, gutter, sidewalk, curb ramps, streetlights, landscaping, and other incidents as per plans approved by the Development Services Department. All improvements shall comply with all Americans with Disabilities Act accessibility standards.
