Request to hold a public hearing and approve the rezoning for the following item by adopting the Planning Commission's recommendation and the related ordinance.

The following stipulations are subject to discussion at the meeting, and the City Council may add, delete, or amend stipulations:

 

Stipulations

 

1.

That the development shall be in general conformance with the site plan date stamped November 20, 2008, with the exception of:

 

 

 

 

a.

Ingress/egress to the commercial development from 47th Street;

 

 

 

 

b.

The refuse containers north of Retail 1;

 

 

 

 

c.

The pedestrian link north of Retail 1;

 

 

 

 

As modified by the following stipulations and approved by the Development Services Department.

 

 


 

2.

That the development shall be in general conformance with the elevations date stamped August 8, 2008, as approved or modified by the Development Services Department.

 

 

3.

That pedestrian access shall be provided to future residential development and located away from refuse containers, as approved by the Development Services Department.

 

 

4.

That a right-turn lane shall be provided into the development along Greenway Road at the driveway entrance closest to Tatum Boulevard, as approved or modified by the Development Services Department.

 

 

5.

That right-of-way totaling 65 55 feet AND A 10-FOOT-WIDE SIDEWALK EASEMENT shall be dedicated for the north half of Greenway Road, as approved by the Development Services Department.

 

 

6.

That right-of-way totaling 65 55 feet AND A 10-FOOT-WIDE SIDEWALK EASEMENT shall be dedicated for the west half of Tatum Boulevard, as approved by the Development Services Department.

 

 

7.

That a 25-foot by 25-foot right-of-way triangle shall be dedicated at the northwest corner of Tatum Boulevard and Greenway Road.

 

 

8.

That the developer shall construct all streets within and adjacent to the development with paving, curb, gutter, sidewalk, curb ramps, streetlights, median islands, landscaping, and other incidentals as per plans approved by the Development Services Department. All improvements shall comply with all Americans with Disabilities Act accessibility standards.

 

 

9.

That in the event archaeological materials are encountered during construction, the developer shall immediately cease all ground disturbing activities within a 33-foot radius of the discovery, notify the City Archaeologist, and allow time for the Archaeology Office to properly assess the materials.

 

 

10.

That the property owner shall record documents that disclose the existence and operational characteristics of the City of Scottsdale Airport to future owners or tenants of the property. The form and content of such documents shall be according to the templates and instructions provided which have been reviewed and approved by the City Attorney.
