Request to hold a public hearing and approve the rezoning for the following item by adopting the Planning Commission's recommendation and the related ordinance.

February 11, 2009 - Approved, subject to stipulations and an additional recommendation that the applicant continue to work on access issues with the neighborhood. Vote 6-1

 

The following stipulations are subject to discussion at the meeting, and the City Council may add, delete, or amend stipulations:

 

Stipulations

 

1.

The applicant shall dedicate a preservation easement above the 20 percent slope line, as approved by the Development Services Department.

 

 

2.

That prior to final site plan approval, the property owner shall record documents that disclose to purchasers of property within the developments the existence and possible impacts with A-1 or Industrial Park zoning to the west. The form and content of such documents shall be reviewed and approved by the City Attorney.

 

 


 

3.

That the applicant shall submit an archaeological survey report of the development area for review and approval by the City Archaeologist prior to clearing and grubbing, landscape salvage, and/or grading.

 

 

4.

That in the event archaeological materials are encountered during construction, the developer shall immediately cease all ground disturbing activities within a 33-foot radius of the discovery, notify the City Archaeologist, and allow time for the Archaeology Office to properly assess the materials.
