Residential Rental Regulations

In addition to general property maintenance and zoning regulations, there are some other regulations and requirements that apply specifically to residential rental properties.    

Rental Registration

The city of Phoenix Neighborhood Services Department (NSD) handles rental registration violations as a requirement of the city’s Neighborhood Preservation Ordinance.  It is required that residential rental properties occupied or listed for rent be registered at the Maricopa County Assessor’s Office even if the tenant is a family member.  Registration information must be updated within 10 days of any changes in status or contact information.  Out-of-state owners are required to provide contact information for a local agent to notify the owners of any code violations, crime and safety issues and property maintenance concerns.

Additional Requirements

  • Property owners who own three or more residential rental units that are rented or available for rent in Arizona are required to obtain a privilege license from the city of Phoenix Finance Department and pay taxes on any residential rental units in Phoenix.
  • Property managers or brokers who manage residential rental units in Phoenix are required to pay taxes to the city even if the individual property owner would not be required to do so.
  • Property owners or managers of one commercial property plus one residential rental unit in Arizona also are required to pay tax to the city of Phoenix on the residential rental units in Phoenix.

Information on the rights and responsibilities of landlords and tenants of residential rental properties is provided by NSD at regularly scheduled free Landlord/Tenant workshops.  You also can learn about landlords’ or tenants’ rights under state law for a specific property or issue through free counseling services to Phoenix residents and landlords’ on a first-come basis weekdays between 8 a.m. and 5 p.m. Monday to Friday, at 200 W. Washington St., fourth floor.
